1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the website, online store, and related services operated by Ark Prep (collectively, the “Site”). By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Store Policies (including Payment, Shipping, Returns, and related policies), which are incorporated by reference.
If you do not agree to these Terms, do not use the Site or place an order. We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age and capable of entering into a binding contract to use the Site and place orders. By using the Site, you represent that you meet these requirements. The Site is intended for use by residents of the United States (with limited exceptions for certain products that may be available in Canada when the Site permits checkout).
You are responsible for ensuring that your use of the Site and any products you purchase comply with all applicable laws in your jurisdiction.
3. Accounts
You may be required or permitted to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at support@arkprepstore.com of any unauthorized use.
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, used fraudulently, or used in violation of these Terms.
4. Products, Pricing, and Availability
We strive to display accurate product descriptions, images, pricing, and availability. However:
Product images are illustrative; actual appearance, color, and specifications may vary.
Prices are subject to change without notice. The price charged is the price in effect at the time your order is processed.
Availability is not guaranteed. We may cancel or refuse any order if a product is out of stock, discontinued, or priced in error.
We reserve the right to limit quantities, refuse orders, or cancel orders that appear fraudulent, violate these Terms, or exceed available inventory.
In the event of a pricing or availability error, we will notify you and either cancel the order with a full refund of amounts paid or offer you the option to proceed at the correct price (subject to availability).
5. Orders and Payment
Placing an order constitutes an offer to purchase. We may accept or decline your offer at our discretion. Acceptance occurs when we process payment and confirm shipment (or otherwise confirm acceptance).
Payment methods, installment options, financing, and related eligibility rules are described in our Store Policies. By submitting payment information, you represent that you are authorized to use the payment method and that the information is accurate.
We (or our payment processors and financing partners) may pre-authorize, charge, or place holds on your payment method as needed to process the order. You authorize us and our partners to charge all applicable amounts, including taxes, shipping, and any restocking or other fees permitted under our policies.
6. Shipping and Delivery
Shipping options, estimated times, address changes, and related rules are set out in our Store Policies. All delivery dates and times are estimates only and are not guarantees. Delays may occur due to factors outside our reasonable control (including manufacturer, carrier, and supply-chain issues).
Risk of loss and title to products pass to you upon delivery to the carrier, or as otherwise required by applicable law. You are responsible for providing accurate shipping information. Additional costs arising from incorrect addresses or failed delivery attempts are your responsibility.
You agree to inspect packages upon delivery and to report freight or visible damage within the timeframes stated in our Store Policies (generally within 24 hours for freight damage, with supporting photos/videos).
7. Cancellations, Returns, and Refunds
Cancellations, returns, exchanges, restocking fees, return shipping responsibility, custom/made-to-order final-sale terms, and related rules are governed by our Store Policies, which form part of these Terms.
Key points (see Store Policies for full details):
Most orders may be canceled free of charge before shipment.
Custom and made-to-order products are final sale and cannot be canceled or refunded once ordered.
After shipment, returns generally incur a 20% restocking fee plus return shipping costs paid by the customer, subject to manufacturer policies and product-page terms.
Brand- or product-specific return rules on the product page take precedence over general return windows.
8. Intellectual Property
All content on the Site—including text, graphics, logos, images, product descriptions, design, and software—is owned by Ark Prep or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Site content without our prior written permission, except for personal, non-commercial use incidental to browsing and ordering.
9. Prohibited Conduct
You agree not to:
Use the Site for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorized access to our systems, accounts, or data.
Interfere with or disrupt the Site, servers, or networks.
Use automated means (bots, scrapers, etc.) to access the Site without our prior written consent.
Submit false, misleading, or fraudulent information, or place orders under false pretenses.
Harass, threaten, or abuse our staff or other users.
Resell products purchased from us in a manner that violates manufacturer policies, applicable law, or these Terms.
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that product descriptions, pricing, or other content will be accurate, complete, or current.
Product warranties, if any, are provided solely by the manufacturer and are subject to the terms stated on the product page or in manufacturer documentation. Ark Prep does not itself provide product warranties beyond any non-waivable rights under applicable law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARK PREP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY ORDER, ANY PRODUCT, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY ORDER OR PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO ARK PREP FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ark Prep and its officers, directors, employees, agents, suppliers, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms or any law; (c) your violation of any third-party rights; or (d) any content or information you submit.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Subject to the informal resolution and (if applicable) arbitration provisions below, exclusive jurisdiction and venue for any dispute shall lie in the state or federal courts located in Illinois.
Informal resolution first: Before filing any formal claim, you agree to contact us at support@arkprepstore.com and attempt to resolve the dispute in good faith for at least 30 days.
Chargebacks: You agree to contact us first to resolve order, shipping, or product issues before initiating a chargeback. Chargebacks filed without first giving us a reasonable opportunity to address a legitimate concern may be contested. Fraudulent chargebacks may be referred to appropriate authorities.
Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, or failures of suppliers, carriers, or utilities.
15. Termination
We may suspend or terminate your access to the Site, cancel pending orders, or refuse service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, or for any other reason we deem necessary to protect the Site, our business, or other users. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, and governing law) will survive termination.
16. General Provisions
Entire Agreement. These Terms, together with our Store Policies and any product-specific terms on the Site, constitute the entire agreement between you and Ark Prep regarding the Site and your orders, and supersede prior agreements or understandings.
Severability. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights, except as expressly stated.
Notices. We may provide notices by email to the address associated with your order or account, by posting on the Site, or by other reasonable means. Notices to us should be sent to support@arkprepstore.com.
